1. Who we are
Hydro Panda is published by Playpal Apps, a sole-trader indie software business operating out of Victoria, Australia. Where these terms refer to "we," "us," or "Playpal Apps," that's who is meant. Where they refer to "you," that means the person using Hydro Panda.
2. The licence we grant you
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Hydro Panda on devices you own or control, for your own personal, non-commercial use, subject to these terms and the App Store / Google Play terms applicable to your device.
3. Not medical advice
Hydro Panda is a general-wellness tool intended to help you build a habit of drinking water more regularly. It is not a medical device, and nothing in the app is medical, dietary, or clinical advice. Hydration needs vary widely by age, health, climate, activity, and medical condition. If you have a condition that affects your fluid intake — kidney disease, heart failure, certain pregnancies, prescribed fluid restrictions, or anything else — please consult a qualified healthcare professional before relying on Hydro Panda's targets or reminders.
By using Hydro Panda, you acknowledge it is not a substitute for medical advice, diagnosis, or treatment.
4. Pro purchases
- Hydro Panda Pro is a non-consumable, one-time in-app purchase priced at $2.99 USD (or local-currency equivalent set by the App Store / Google Play).
- Pro is lifetime — there is no recurring billing and no expiry.
- Pro is restorable on any device signed into the same Apple ID (iOS) or Google Play account (Android) via Settings → Restore purchases.
- iOS Family Sharing is supported. A Pro purchase by one family-group member grants Pro to all members in that family group.
- Refunds are handled by Apple or Google directly under their respective refund policies — Playpal Apps cannot directly issue refunds. On iOS, request via reportaproblem.apple.com. On Android, via Play Store → Account → Purchase history → Request a refund.
- If a store declines your refund and you feel there's a legitimate issue with the app, email playpalapps2024@gmail.com and we'll advocate for you.
- Pricing may change for new purchases over time; existing Pro purchases are unaffected — your lifetime is genuinely lifetime.
5. Your content
Hydration entries, settings, names, and any other data you create in Hydro Panda are yours. We claim no ownership. Because the app is offline-first and we don't operate any servers, we don't even have access to your data unless you explicitly share it with us — for example, attaching a screenshot to a support email.
6. Acceptable use
- Don't use Hydro Panda for any unlawful purpose, or in violation of any laws applicable to you.
- Don't reverse-engineer, decompile, or disassemble the app, except where the law expressly permits.
- Don't redistribute the app, its assets, or its code.
- Don't attempt to interfere with the app's operation, in-app purchase verification, or to circumvent licensing checks.
7. As-is, with no warranty
Hydro Panda is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or 100% accurate. We do commit to acting in good faith — shipping bug fixes, being honest about limitations, and not pulling features you paid for without a clear path forward.
8. Limitation of liability
To the fullest extent permitted by law, in no event will Playpal Apps be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of Hydro Panda. Our total aggregate liability for any claim relating to Hydro Panda is limited to the greater of (a) the amount you paid us for the app in the twelve months preceding the claim, or (b) AUD $50.
Some jurisdictions don't allow certain disclaimers — if yours doesn't, the disclaimed items only apply to the maximum extent permitted where you live. Nothing in these terms excludes any consumer rights you have under non-excludable law (for example, the Australian Consumer Law).
9. Indemnification
If your use of Hydro Panda violates these terms or applicable law and that causes us (or a third party) legal exposure, you agree to indemnify and hold us harmless from the resulting claims and reasonable costs.
10. Termination
You can terminate this agreement at any time by uninstalling Hydro Panda. We may terminate or suspend your licence with reasonable notice if you materially violate these terms. Paid, non-refunded entitlements (Pro) survive such termination only on devices that don't require a fresh restore — practically, this rarely matters because Pro is store-account-bound.
11. Changes to these terms
We may update these terms from time to time. Material changes will be surfaced in-app via a changelog entry linking here, and the "Last updated" date above will change. Continued use of Hydro Panda after a change means you accept the updated terms. If you don't accept them, stop using the app.
12. Governing law
These terms are governed by the laws of the State of Victoria, Australia, without regard to conflict-of-law rules. Any dispute that can't be resolved amicably is subject to the exclusive jurisdiction of the courts of Victoria, Australia. This does not affect any non-excludable rights you have under the law of the country in which you live.
